Sunnys Salon is claiming to teach our personally developed "VOGUEPEARL" extension technique at their salon, as shown on their Facebook and Instagram socials.
Upon our asking them to remove our trademarked name from their posts description, we were instead blocked and our comment deleted. However, the description stayed up with the use of our trademarked name.
An un-official cease and desist email has been sent, which asks this company to discontinue the use of our brands likeness in an attempt to profit off our brands reputation.
Please be advised that this company is NOT affiliated with The Extensionist, or VOGUEPEARL.
here is the email that was sent in its entirety:
"Hello,
My name is Megan, CEO of The Extensionist, The Extensionist Academy, and creator of the VOGUEPEARL technique + creator of the VOGUEPEARL name.
2 of my students in the Fort Mcmurray area have brought to my attention that your salon is claiming to teach my technique within your salon.
Upon investigating, I can see you have used my extension technique + its name in both your Instagram and Facebook posts.
I have not provided your business or any of its affiliates expressed permission to use the word VOGUEPEARL.
Therefor, you are currently infringing on my brand’s likeness in an attempt to profit for your business.
I will ask that you cease and desist from using the word VOGUEPEARL in any and all classes & installs, or I will be forced to take further action, where I will seek royalties for all previous, current & future classes you teach using my brands likeness.
I will ask that you write to confirm you will forfeit from using my trademark name to benefit your business.
I understand that the name VOGUEPEARL is a big name in the extension industry, so I understand why it would be “easy” to use it. I have built my technique from the ground up over the last decade, and am proud of the reputation behind it. My students spend good money to learn the actual VOGUEPEARL installation straight from myself- the creator; therefor, when you infringe on my hard work, it cheapens the overall experience for everyone, and that it not fair.
I will be contacting our corporate lawyer within 7 days if I have not received written confirmation that you have both received my email, and agree to refrain from using my brands name.
