Though I am still waiting on my payout these things take forever, I find that Mark is kind and very understanding, he was completely honest with me on what to expect, I was injured in a restaurant, he laid it flat out he didn’t expect anything from this cause I am already pensioned off and thought the settlement is very small I feel they did the best they could for me. It was never about the money it was the principal of the thing, They take the necessary time, and explain why, it will be three years in august since the accident. I hope at some point the insurance company’s have to become accountable and start to pay out properly and not be allowed to hold on to your money until they feel they should cut a cheque. update 11/11/2019: Due to long delays in treatment and refusal of ICBC from financing the Botox injections by Neurologist I ended up at VGH emergency and unable to drive since then. No one cared about my inability to work other than my lawyer who arranged an emergent surgery to fuse my vertebrae and prevent from permanent nerve root damage and get me back to work. make sure your chosen law firm is always there for you, some of them are not when you need them most update: The ICBC refused to consider a fair payment at the mediation so my lawyer refused it and instead secured a court date in 9 months from now. These days it is second to impossible to get a 10 day court date this fast. Make sure you choose a lawyer that has no hesitation in going to the court if needed and arranges that ASAP. Since the lawyers do every thing possible to make their client settle to any compensation in mediation, so that they can cash the cheque and move to their next case. Mr Mussio did exactly the opposite. He refused the unfair settlement without asking me to even consider the unfair settlement. And the next day he extended my court time from 5 to 10 days and secured it. I need to applaud his clear conscious. update: I received the expert report of a top notch neurosurgeon hired by my lawyer. The neurosurgeon simply disqualified the ICBC radiologist who had written a negative report about my neurosurgical condition without ever examining me. For this, I am very thankful to my lawyer. Update(May01/17): This is what I wrote about a week ago. Today I was informed that Mr Mussio will personally go over the DISCOVERY with me, before my official face to face appointment with ICBC lawyers. Love the fact that he is heading to legal proceeding without hesitation. Normally, lawyers hate lengthy legal proceeding since they make more money by wrapping up more cases with less compensation as compared to few lengthy cases with more compensation. Not difficult to understand that they compromise your compensation to ICBC in order to shorten your case time and reach their own client turn over goal. Heads up, If your lawyer is hesitant to explore the full capacity of your damages then he/she is getting ready to give a good discount to ICBC out of your pocket. I have an active file with Mr. Mussio. Around a week ago, I read the memo that Mr. Mussio had sent to me. It was really well crafted and has a clear approach/attack plan. As a legal client nothing is as comforting as knowing that your lawyer has a well crafted and proactive plan in order to neutralize the unfounded ICBC claims that any petitioner will face anyways. Believe me, if you have a lawyer sitting on his/her hands waiting for ICBC experienced lawyer to dictate the course of actions and then react to their demands, clearly you have a passive/reactive lawyer. You must find a lawyer who provides/engages you with a road map in order to bullet proof your lawsuit proactively. Otherwise, instead of being a prepared petitioner in the court of law, you will find yourself acting like an unprepared defendant who struggles to defend the credibility and basis of your claims against ICBC lawyers
