I cannot recommend Samfiru Tumarkin, specifically Lia Moody, enough. I had received notice that after 12 years with a company they were closing the branch and terminating the employment of all employees. The company had claimed that the amount of notice we were all given negates any severance they would be obligated to provide any employees. This sounded accurate in the way it was worded, however I still wanted to contact someone to figure out my rights and if this was accurate. Having heard radio adds for Samfiru Tumarkin, I contacted their Vancouver location and was put in contact with Lia Moody. She was incredible from the beginning of the process right through to the end. She let me know that due to my managerial position, the notice I was provided was nowhere near sufficient and was immediately to work on a letter to the company. It started out with an informative Zoom Consultation. Later on was mostly emails exchange because of covid. The process took about 3 months. One thing to note for anyone who is worried and unsure about the unknown hefty lawyer fees. You can always go with the contingency option! (1/3 of what Lia can get for you goes to her, 2/3 you keep for yourself). You don't have to worry about receiving a monthly bill etc. Hourly rate is a great option as well if you are confident with your case. But back to Lia, she really cares and wants the best for you - whether it is to "get your job back" or to suggest the best option to go further or to settle. I do not feel pressure to decide. If you are seeking legal advice for a labour or employment related issue look no further. I was terminated ‘without cause’ from my job and offered a basic severance package that fell under the minimum amount required in BC. I knew that I needed to get legal advice regarding the signage of a legal document (severance) and I also had questions regarding workplace harassment. I contacted Samfiru Tumarkin law firm, an experienced labour and employment law team. I contacted them through their website by filling out their online form, outlining my issue along with my email address and cell number. My request was submitted late in the day after 3 pm and the firm contacted me at 9 am the next morning. It was an ‘intake’ conversation and I was asked some questions. Shortly thereafter they sent me an email requesting documents (termination letter, employment contract, etc.) and they already had a telephone meeting with a lawyer set up for me the next morning. In that email I was given the contact details of Aliya Virani who specializes in labour and employment law. The process was quick, efficient, user-friendly, and unintimidating. My initial 30 minute telephone conversation with Aliya was complimentary. Aliya led the conversation and used her knowledge and highly efficient communication skills to pierce through my emotions and confusion in a very compassionate and kind way. In that consult she successfully obtained all of the important information from me including length of employment, termination without cause, severance offered, examples of workplace harassment, and more. She effectively informed me of BC employment and labour legislation, such as the Employment Standards Act, the Human Rights Code, and Common Law. She explained how I may be eligible for up to 3-4 months severance pay (I was offered 3 weeks) based on several factors such as length of employment, age, etc. I was informed of what I would be required to do if I was successful in obtaining longer severance, such as prove that I am looking for work. Regarding workplace harassment, Aliya discussed this with me from several angles informing me of the route that I would have to take, such as filing a complaint with the Human Rights Tribunal and how I could file a complaint on my own, with or without representation from a lawyer. The pros and cons of doing so were discussed. I was also informed of the cost of obtaining legal representation should I choose to move forward with the service. At the end of our 30 minute conversation I had a solid understanding of where I stood with respect to my options and my rights. I couldn’t believe how effective and efficient the conversation was, which helped me immensely at such a stressful time. Samfiru Tumarkin law firm helped me to understand my options after being terminated from my job including the best course of action to take. I felt understood and supported. I spoke with Dan Balkaran at Samfiru Tumarkin about my dad's termination. My dad had immigrated to Canada in the 80s and had worked at his company for almost 20 years. His termination rocked our family, but luckily we came across Dan. Dan went above and beyond in counseling us and really made us feel as if we were in good hands. He was responsive and always answered our emails promptly. He explained legal concepts thoroughly, but still in a way we could understand easily. However, what I appreciated the most about Dan was he made my dad feel heard and vindicated.
